Summary of the statutory obligation for the use of the EORI number

Entry:

Statutory obligation:

  • Pursuant to art. 183, paragraph 1 of the CCIP, the entry summary declaration (ENS) must contain the data required by Annex 30a.
  • Pursuant to art. 186 of the CCIP, in conjunction with art. 2:5, paragraph 3 of the Algemene douaneregeling, the summary declaration for temporary storage (SAL) must also contain the data required by Annex 30a.

List of persons ENS/SAL – mandatory EORI number or name, address, place of residence:

  • Consignor
    Provide consignor’s EORI number.
    No EORI number known by the person lodging the  ENS/SAL? State: name, address and place of residence.
    Addition: Only in the situations described in article 4l, paragraph 3 of the CCIP(see Annex) a non-EU established economic operator needs to have an EORI number.
  • Person lodging the summary declaration
    EORI number mandatory.
  • Person lodging the diversion request
    EORI number mandatory of the person submitting the diversion request.
  • Consignee
    Is the consignee not the person lodging the summary declaration?
    Then provide: the consignee’s EORI number.
    No EORI number known by the person lodging the ENS/SAL? State name, address and place of residence.
  • Carrier
    In case the carrier is not the person lodging the ENS/SAL?
    Then provide: the EORI number, or the third country unique identification number granted within the framework of a mutual recognition agreement.
    If the EORI-number or third country unique identification number is not available to the person lodging the ENS/SAL and there is no sea, inland waterway, or airway transport? Then provide the full name and  address of the carrier.
    Attention
    In situation provided for in:
    • article 183, paragraph 6 CCIP (notification ENS registration)
    • article 183, paragraph 8 CCIP(notification ENS amendments registration)
    • article 184d, paragraph 2 CCIP (no-load notification)
      the carrier’s  EORI number must be provided for the purpose of electronic notification.
  • Notify party
    Provide, where applicable,  the EORI number of the person to be notified of the arrival of the goods upon arrival.
    No EORI number known by the person lodging the ENS/SAL?  State name, address and place of residence.
    Attention
    If the goods are transported while covered by a transferable bill of lading ‘blank endorsed  to order’ , code 10600 (=details consignee unknown) must be stated  in the consignee box.

Exit:

Obligations

  • Pursuant to article 842b, paragraph 1 of the CCIP, the exit summary declaration (EXS) must contain the data required by Annex 30a of the CCIP.
  • Pursuant to Annex 30a, Introductory notes to the tables, note 3, the export declaration not only has to contain the data from Annex 37/37a, but also de data of the exit summary declaration (EXS).

Please note!

Currently only the name, address and place of residence can be stated in DSU. It is not possible therefore to state an EORI number. As DSU will be replaced, this will not be possible until the new declaration system (AGS) is operational.

List of persons EXS

  • Consignor
    To be completed if the consignor is not the person lodging the EXS.
    Provide: consignor’s EORI number.
    No EORI number known by the person lodging the EXS? State name, address and place of residence.
    If the data required for an EXS has already been included in the customs declaration pursuant to article 182b, paragraph 3, CCC and article 216 of the CCIP, this data is equivalent to the "Consignor/Exporter" of that customs declaration.
  • Person lodging the summary declaration
    EORI number mandatory.
  • Consignee
    Provide: consignee’s EORI number.
    No EORI number known by the person lodging the EXS? State name, address and place of residence.

    Exception: In cases provided for in article 789 of the CCIP(subcontracting), provide information when available. Subcontracting is currently not been operated in the Netherlands.

    Addition: a non-established EU economic operator requires an EORI number only in the situations described in article 4l, paragraph 3 of the CCIP (see Annex).

Import/Export/Transit

Statutory obligation

Pursuant to article 62 CCC in conjunction with article 212 and Annex 37 of the CCIP, article 2:11 and Annex VI Algemene douaneregeling + The Toelichting Enig document (notes to the Single Administrative Document - only available in Dutch, an EORI number must be provided in the following situations.

List of persons in customs declaration

Import (Annex VI, Part C Algemene douaneregeling):

  • Consignee (box 8)
    EORI number mandatory, unless private person.
    Private person? State name, address, place of residence or NL plus citizen service number (BSN).
    Attention!
    Currently only the name, address and place of residence can be stated in DSU. It is not possible therefore to state a EORI number. As DSU will be replaced, this will not be possible until the new declaration system (AGS) is operational.
  • Represented person (box 9)
    EORI number mandatory, unless private person.
    Private person? State name, address, place of residence or NL plus citizen service number (BSN).
  • Declarant (box 14)
    EORI number mandatory, unless private person.
    Private person? State name, address, city or NL plus citizen service number (BSN).

Export (Annex VI, Part C General Customs Procedure)

Pursuant to Annex 30b, Introductory notes to the tables, note 3 of the CCIP, the export declaration must also contain the data of the EXS, in addition to the data of Annex 37/37a of the CCIP. That is why the export part should be read in conjunction with the obligations applicable upon exit (with the exception of export to NO/CH/AD/SM).

  • Consignor/exporter
    EORI number mandatory, unless private person.
    Private person? State name, address, place of residence or NL plus citizen service number (BSN).
  • Consignee (box 8)
    Name, address and place of residence mandatory for agricultural goods qualifying for export refunds.
    (NB Annex 30a does require name, address and place of residence/EORI number! Also see exit)
  • Represented person (box 9)
    EORI number mandatory, unless private person.
    Private person? State name, address, place of residence or NL plus citizen service number (BSN).
  • Declarant (box 14)
    EORI number mandatory, unless private person.
    Private person? State name, address, place of residence  or NL plus citizen service number (BSN).

Transit NCTS/Transit declaration (Annex VI, Part B, Algemene douaneregeling Procedure):

  • Consignee (box 8)
    Under the current national legislation it is sufficient to state the name, address and place or residence. This box does not need to be completed if the consignee is not established in the EU or in an EFTA country. It will be mandatory from 01/01/2013 onwards to provide an EORI number if the consignee is established in the EU. It is advisable to start providing the consignee’s EORI number prior to this change.
  • Declarant (box 50)
    EORI number mandatory.
  • Authorised consignee (box 52)
    EORI number mandatory.

Annex: Article 4l, paragraph 3 of the CCIP

3. Where an economic operator not established in the customs territory of the Community does not have an EORI number, he shall be registered by the customs authority or the designated authority of the Member State where he first performs one of the following:

  1. he lodges in the Community a summary or customs declaration other than any of the following:
    1. (i) a customs declaration made in accordance with Articles 225 to 238;
    2. (ii) a customs declaration made for temporary importation or for discharging this procedure by re-exportation;
    3. (iii) a customs declaration made under the common transit procedure by an economic operator established in a contracting party to the Convention on a common transit procedure other than the European Union, where that declaration is not also used as an entry or exit summary declaration;
    4. (iv) a customs declaration made under the Community transit procedure by an economic operator established in Andorra or in San Marino, where that declaration is not also used as an entry or exit summary declaration;
  2. he lodges in the Community an exit or entry summary declaration;
  3. he operates a temporary storage facility pursuant to Article 185(1);
  4. he applies for an authorisation pursuant to Article 324a or 372;
  5. he applies for an authorised economic operator certificate pursuant to Article 14a.
